The TKPOTD from a year ago today dealt with one of Brett Kimberlin’s requests to the Court of Appeals for the Seventh Circuit for a freebie lawyer to help with an appeal.

Brett Kimberlin claimed that he has a lawyer willing to represent him pro bono in the filling of a petition for a writ of certiorari seeking to appeal the his recent loss in the Seventh Circuit.As of close of business yesterday, nothing is on the public docket at the Supreme Court’s website. However, Kimberliin has several week’s left before the filing window closes.

The Seventh Circuit denied his motion for appointment of counsel. Then, it affirmed the District Court’s denial of Kimberlin’s motion for DNA testing of evidence that no longer exists.
Kimberlin didn’t appeal his DNA motion, but his pro bono counsel did file a petition for a writ of certiorari with the Supreme Court. That petition was denied.
