Brett Kimberlin has been trying to have some of his Speedway Bombing convictions overturned. His latest efforts failed in the U.S. District Court in Indianapolis, and the Court of Appeals for the Seventh Circuit affirmed one of the District Court’s decisions earlier this month. (A second case is still pending.) Kimberlin has filed a motion for extension of time to appeal for an en banc rehearing of his appeal.
The Court of Appeals has said, “No, get your paperwork in on time if you want us to consider it.”
It’s entirely possible that Kimberlin didn’t get the court’s decision in the mail until the 14th. However, after Hogewash! broke the news of the denial of his appeal, several major websites covered the story. Even if he’s stopped reading Hogewash!, I’ll bet he still has a Google alert on his name and would have been aware of the decision before the end of the 7th.
We’ll see if he files for a rehearing before the deadline.
