Team Kimberlin Post of the Day


Only one of the Team Kimberlin LOLsuits ever made it as far as a trial. That was the Kimberlin v. Walker, et al. nuisance LOLsuit. This TKPOTD ran three years ago today in the aftermath of that trial.

Brett Kimberlin is not a good listener. This exchange is from one of the bench conferences during the Kimberlin v. Walker, et al. nuisance lawsuit. Judge Johnson was trying to explain to The Dread Pro-Se Kimberlin about hearsay testimony from the Kimberlin daughter about things she did not witness.

THE COURT: — assume all of that is true, what does this 15-year old have to do with that?

MR. KIMBERLIN: Because she was harmed. She’s been harmed. She’s been run out of two schools and —

THE COURT: She’s not a party.

MR. KIMBERLIN: And they have defamed her. They have —

THE COURT: She’s not a party.

MR. KIMBERLIN: I know, but they have gone on her, she’s a very accomplished musician. They have gone on her websites. They have attacked reporters —

THE COURT: I don’t disagree with any of that, but she is not a party.

MR. KIMBERLIN: It’s not that she’s a party. They are using the pedophilia against me, against her and they’re doing it to harm me.

THE COURT: Sir, but you’ve got to understand something. We have rules here. You can’t just bring people in to just testify when they A, they didn’t witness anything that they’re competent to testify about and B, she is not a party to this lawsuit.

Judge Johnson seemed to care more for Miss Kimberlin that TDPK did.

THE COURT: But see what I’m trying to avoid is having this little girl come up here, objection sustained, objection sustained, objection sustained. And then having, putting her through that and having nothing really come of it. She can testify to —

TDPK put her on the stand any way, resulting in the following objections to questions or testimony that were not allowed by the rules of evidence.

MR. OSTRONIC: Objection.
THE COURT: Sustained.

MR. OSTRONIC: Objection.
THE COURT: To him leading the witness, sustained.

MR. OSTRONIC: Objection.
THE COURT: Sustained.

MR. OSTRONIC: Objection.
THE WITNESS: And I know —
THE COURT: Objection is sustained.

MR. OSTRONIC: Objection.
THE COURT: Overruled.

MR. OSTRONIC: Objection.
THE COURT: Sustained.

MR. OSTRONIC: Objection.
THE COURT: Sustained. Counsel, sir, stop leading the witness.

MR. OSTRONIC: Objection, Your Honor.
THE COURT: Come up here.
[Bench Conference]
THE COURT: Sustained.

MR. OSTRONIC: Objection.
THE COURT: Has your mom ever done anything hurtful to you? Sustained.

MR. OSTRONIC: Objection.
THE COURT: Sustained.

MR. OSTRONIC: Objection.
THE COURT: Sustained.

MR. OSTRONIC: Objection, Your Honor.
THE COURT: Sustained.

MR. OSTRONIC: Objection.
MR. KIMBERLIN: By these defendants?
MR. OSTRONIC: Objection.
THE COURT: I will sustain the objection in that this young lady is not a party to this case. She did not sue these men. Or you didn’t sue them in her name which would have to be the case. If a minor child is bringing the case it would have to be brought by her Next Best Friend who is generally the parent. She is not a party in this case.

MR. OSTRONIC: Objection.
THE COURT: Sustained.

MR. OSTRONIC: Objection.
MR. KIMBERLIN: — to have sleepovers —
MR. OSTRONIC: Objection.
MR. KIMBERLIN: — or come to the house or be around you —
THE COURT: Sustained.
MR. KIMBERLIN: — because of —
THE COURT: Absolutely hearsay.

MR. OSTRONIC: Objection.
THE COURT: She can answer, overruled.

MR. OSTRONIC: Objection.
THE COURT: Hold on, anything else? No, you don’t just get to keep going. You have to ask another question.

MR. OSTRONIC: Objection.
THE COURT: Sustained.

MR. OSTRONIC: Objection.
THE COURT: Sustained. Sir, you’re going way off base.

MR. OSTRONIC: Objection.
THE COURT: You need to do whatever you need to do with admissible evidence pursuant to the rules of evidence and to the law. And I’ve allowed you some, I’ve given you a long leash.
MR. KIMBERLIN: You have and I appreciate it.
THE COURT: And let you run pretty far out there. But I’m now pulling you back in.

MR. OSTRONIC: Objection.
THE COURT: Sustained.
MR. KIMBERLIN: Is it affecting —
THE COURT: Sustained.
MR. KIMBERLIN: No further questions.

I cannot find the words to adequately express my disgust with someone who would needlessly inflict that on a child.

The defendants did not question Miss Kimberlin. We had agreed among ourselves that we would not do so—even if she could have offered probative testimony—because we did not want to compound what we believed was abuse of the young girl.

    I have plenty of words to express my revulsion about Kimberlin in general, and what he has done to his family in particular. I will restrain myself to saying just that world will be a much better place when Kimberlin is no longer involved with it.

    I better just end it here, before one of Brett’s associates starts accusing me of making death threats…

  2. Kimberlin fails.

    A transparent attempt to use a child in order to garner sympathy and advance his case. Kimby has seen way too many movies wherein eloquently emotional appeals carry the day over procedural law. With regard to said movies, double-ditto for Schmalfeldt. Cue the music. And this is how it is for those of The Left: You can always get something for nothing and there’s never any cost when appropriate emotion rules. Justice uber alles.

    Frack these people, their attitudes, their worldview and the horse they rode in on.

    What a difference in 3 years.

  4. Family, of both friends and foes, have been part of the resources that Kimberlin has (cold-bloodedly?) drawn on in trying to pursue his goals:

    – I recall Kimberlin claiming that his (then-dead) brother, Scott, was the one responsible for the Speedway bombings;

    – When Sandra deLong tried to collect on the damages award that was granted her from a civil trial, Kimberlin eventually went back to prison for what the parole board decided was unreasonable attempts to keep assets/revenue away from her reach, e.g. (a) Revenue from “Citizen K” went to “BKE Inc.”, which Kimberlin claimed was owned by his sister; and (b) His mother put a lien on his house, (apparently because she helped cover BK’s legal expenses), such that the house was also out of reach of DeLong;

    – When Mandy Nagy suffered a stroke, BK still went after her in a lawsuit, using Mandy’s mother as a proxy.

    – When young K. released a single (& video, I think), and BK was interviewed in relation to the release, he somehow managed to manoeuvre the interview to include himself in its focus.

    These are in addition to the material above, and note also recently Tetanya being involved in litigation, contradicting under oath what she had previously signed under penalty of perjury, and being notified by the Judge that she might need to take the 5th.

  5. It sure is telling when the Defendants have more compassion for the PedoBomber’s daughter, by not cross examining her, than her own father does.

  6. Sociopaths gotta sociopath. They don’t give a darn about people seeing in real time that they care for no one but themselves as long as they can get what they want. There is no real penalty for just being a sociopath intil they get caught and convicted of breaking a law. And maybe not much penalty then.

    Indeed. And, just look at how Tetyana’s daughter is turning out… a lying, illicit drug possessing/using, sticky-fingered, self-entitled malefactor with no respect for others, no respect for other’s property, no respect for law enforcement, and no respect for rules nor laws.

    How KK would have turned out had she been raised solely by her Mother is anyone’s guess… but, I doubt anyone would argue that the Domestic Terrorist Brett “The Speedway Bomber” Kimberlin’s involvement and influence in the little delinquent’s life netted much of anything positive or virtuous or respectable. And, the fact her poor-excuse-for-a-Mother had numerous opportunities, and generous offers of help and support in order to live her life, and her children’s lives, sans the dwarf felon – and, opted *not* to make the difficult, yet all-important, choices and decisions that were in the best interest of all of them – is just one more thing Kimberlin related that makes one struggle to find the words to adequately express disgust.

    Here’s to hoping KK finds her way in this world… and, desperately tries – in spite of her unstable upbringing and poor, poor role models – to make something good and decent and successful out of herself and her life.

    • Prayers for KK are in order. And for the other members of Team Kimberlin. The only ones who can really change them are themselves and they will need to help of God to do so.
