I have to admit that I did not expect the judge in the LOLsuit VIII: Avoiding Contact case to kick the Cabin Boy’s™ second amended complaint back to the magistrate judge for review and recommendation, so I’ll say that somethings are proceeding better than I have foreseen.

Nothing is proceeding as the Cabin Boy™ has hallucinated.

  1. It has been said that Diseased Williy is a bit slow in the thinking department. It apparently did not occur to him that if magistrates must approve a complaint, then filing an amended complaint sends every thing back to square one, at least with respect to those defendants who have not yet been served.

    Cursed are those who are weak in the head, for they will stumble into the pit without a clue.

  2. There are times when I am reviewing reports that they are so off, I couldn’t edit them. I have to kick them back and say “toss this and start over”. This might be one of those times where the magistrate does the same except with prejudice.

  3. Everything will proceed as Bill has foresaw. He didn’t destroy his diversity claim and this is just a minor hiccup an email to the Magistrate will fix in a jiffy.

    • I thought that name looked familiar. John ‘Totalbiscuit’ Bain did a video on Mauer’s misbehavior. She was using Youtube’s copyright takedown system to put copyright strikes on any channel featuring Starr Mazer footage.

      Needless to say, Totalbiscuit was not happy (he is not fond of DMCA misuse and extremely critical of how Youtube handles strikes).

      • Interesting story – it highlights to me the need for small, independent companies and developers to never skimp on legal advice in the formative stages, and for everyone to have all of their rights and obligations nailed down by contract before you ever start doing work together. Even then, you can still get a bad actor who goes off like this – but anyone who says they just wanna collaborate, they don’t want to go through all of that contractual stuff, that’s always a time bomb waiting to go off. As soon as any money starts coming in, they’re going to make a play for as much of it as they can get.

        • Evidently even IF you have a legal contract, you can still come to grief. And as TB illustrates, the channels getting hit by strikes weren’t even part of the dispute!

          If a law is this prone to abuse, it’s definitely in need of review.

  4. When I was told that IFP petitioners were babysat *hard* I had no clue Sinclair was meaning this many nits would be picked. It’s fascinating and amazing.

  7. One of the breakout sessions at last years Kimberfest was ‘OPSEC.’ Operational Security. The session was very well attended but our community has expanded since then. Therefore.

    All of you, please be conscious of educating the monkey. To the extent you can, don’t.

    Try hard not to cue Fat Bastard with respect to deficiencies, concepts, malapropisms and ESPECIALLY legal references. Same goes for Boom Boom.
