Team Kimberlin Post of the Day

The Kimberlins alleged in their most recent filing that I did not moderate any of the comments submitted for the 17 April, 2017, TKPOTD. They are wrong. In fact, I deleted three comments. Two failed to meet my standards for decorum. One made a comment about a member of someone’s family who I consider to be off-limits. I also didn’t let two comments from a newbie through moderation because they were obscene.

The Dread Pro-Se Kimberlin seems to be making it up as he goes along, and he isn’t doing a very good job of piecing together a believable story.

Everything is proceeding as I have foreseen.

  1. At this point it would take a Schmalrus or Pedo bomber to not foresee what will proceed. My grandchildren could get most of it. [Ages 3 and 6]

  3. My opinion is that Kimberlin & Co. have never grasped the role of allegations in modern civil procedure in the US, which procedure is, again in my opinion, almost as stupid as those sucked into Kimberlin’s orbit.

    It is true that, with respect to allegations in a plaintiff’s civil complaint, US civil procedure gives them great initial deference. But this is only temporarily true and does not apply to every allegation in every motion. In any case, the deference does not apply to allegations by defendants.

    Karma is an evil bitch.

  4. In the last TKPOTD, Dr_Mike pointed out how The Sawed-Off Pedo Bomber had deleted a whole bunch of comments from that thread.

    Could that action have been a demonstration of how The Sawed-Off Pedo Bomber thinks it should be done?

    Oh, and that explains why the filing wasn’t submitted “under penalty of perjury.” I guess he learned THAT lesson from his prison term…

    • I can only hope he will be stupid enough to introduce that post into evidence.

      Unfortunately, he is not Bill Schmalfeldt, so my usual talisman of saying “not even Bill Schmalfeldt is stupid enough to…” does not apply.

      Still, while Brett isn’t stupid enough to quote me on that, he’s incompetent enough to quote me by accident…

  5. Mr. Hoge has often moderated my comments in the form of disallowing them.

    It doesn’t bother me because know I’m a vile asshole. He makes me strive to better myself.

  6. He deleted my entire seven paragraphs about the literary accomplishments of Victor Appleton Jr. and their relevance to the current controversy. Not fair! I don’t think John wants to be my friend any more. Sniff. Sniff.

      And don’t be envious about being named Defendants, either, I only got that for pointing Bill’s relatives to two posts back at BillySez, where he had been offering to trade corpse-pics for email addresses. Nobody was asking, nobody but him was offering, and I’m pretty sure he never took those pics or he would have “cleverly” framed folks for it like he tried with AG and Hoge… “But your Honor! I only emailed these photos to these two (OK, truthfully only one of them) and these eighteen others. This other guy posted a copy! One of them must have violated my (unsolicited, non-legally binding) remonstrances not to reproduce what I sent them unsolicited…

      Proof! Proof! JWR is 80 PROOF!!!!

  8. No, my friend the recent filings have been more than a pain they are very generous gifts and admissions against interest. Any lawyer who received them would do a happy dance.
