Hoge v. Kimberlin, et al. News

There was a hearing in the case this afternoon. Judge Hecker had issued an order compelling Brett Kimberlin to fully answer certain interrogatories propounded to him in discovery, and The Dread Pro-Se Kimberlin had refused to do so. Judge Hecker then issued an order to TDPK requiring him appear at the hearing today to show cause why he was not in contempt of court.

I expected that TDPK would purge his contempt, and he did so, but not in the way I thought he would. I thought he would invoke his Fifth Amendment right against self-incrimination. Instead, he chose to fully answer the interrogatories under oath in open court. Of course, his answers seem to be contradicted by documentary evidence, but that’s a separate issue which he may have to deal with at a later date.

I also brought up the pending motion to compel discovery from the Cabin Boy™ and the pending contempt petition from him. The judge noted that the motion was ripe and that he should rule on it soon.

So everything is proceeding (more or less) as I have foreseen.

      Sure, “lawsuits for the rest of their lives…” just not against them.

    What exactly does this mean? Does this mean that he can rule that Broadway Bill Schmalfledt of 94.7 the MAC in cillinton, IA, someone who has allegedly faked Parkinson’s and collected tax payer benefits, has contempt of the court and an arrest warrant can be issued? Does it mean that he will not be able to claim “I never got the notice” to avoid contempt?

    IIANAL WO I don’t know how this works now.

        Well look at that it is only a 13 hour 824 mile drive from Clinton to Carrol County or a 3hr 40 minute $606–round trip price– flight from Moline, IL—Baltimore, MD.

    In Lord Dewclawland, there would be very little patience for such tomfoolery.

      Refuse to follow the rules… refuse to abide by court demands… and…

      Just show up in court and say, “Now I’m ready to respond.”

      And The Judge says, “It’s all good.”


    • I suspect that in Lord Dewclawland, “breaking on the wheel” might *still* be an option for punishment of miscreants.

      For those not familiar with this punishment, it involves spreadeagling the subject on a vertical wheel, securing the limbs, strategically breaking the bones in said limbs, then rotating the wheel so the subject’s weight causes the broken bone ends to grate together.

      Spectacularly painful…

        In Lord Dewclawland, punishment would be proportionate to the crime, and look in totality at the situation and the guilty party.

        Having worked in law enforcement, I have seen first hand career criminals that were not deterred by punishment. They resumed their lawless ways as soon as they hit the streets.

        I have no patience for that…. or for those who abuse the system to get back at law abiding people who play by the rules.

        In the perfect world of Lord Dewclawland, miscreants like that would find justice… and not like it one little bit.

    • He hasn’t really paid any sort of price for any of his perjury so far, so what is going to be the motivation for him to stop now?
