Team Kimberlin Post of the Day

On 23 January, I filed a motion in the Hoge v. Kimberlin, et al. lawsuit asking the court to order The Dread Pro-Se Kimberlin to show cause why he should not be found in contempt for his failure to obey the court’s order regarding discovery. That motion was granted, and the show cause hearing is scheduled for 17 March.

I served copies of my motion on the Kimberlins and The Dreadful Pro-Se Schmalfeldt by mail on the 23rd. The mail sent to Schmalfeldt at his Wisconsin address was returned.

Not only was the mail undeliverable in Wisconsin, but there was also no forwarding address on file. So, for the time being, the USPS is unaware of which porch the Cabin Boy™ is hiding under.

Speaking of missing mailboxes … Hmmmmm.

Cowardly cowards gotta cower.

  1. Well, the judge isn’t going to like that. It almost looks like someone is trying to duck legal responsibilities and collections.

    • Except people trying to duck legal responsibilities usually have to good sense not to tell the Judge in the case on twitter, or elsewhere.

So…file a motion asking for a show cause hearing requiring the DUMBFUCK to appear (in his cool new truck and superbadass pleather jacket!) and explain why he shouldn’t be held in contempt, and also sanctions, and also reimbursement for 50 process servers fanning out across America to track him down and serve him?

    Sounds like a plan!

    Unless he’s moved to Iceland…

  3. Hmmmm… Isn’t it a big no-no to move and not inform the parties involved (including the court) where you skulked off to?

    Must be another one of those “technicalities” that causes the Rotund Rump Ranger to lose his legal cases to John.

    But otherwise…. he “ownes” John in court.


  4. Maybe it’s just me, but if there was ever a time to adopt the practices of your adversary, such as filing for summary or default judgment and getting creative with proof of service…


  5. Just include the required documents in a post here and wait. Within 60 minutes of posting Teh Blab will make angry comments that show he has read the papers and (as usual) doesn’t like what he reads..

  6. Kinda makes me wonder what a skip trace costs these days. And if the Cabin Boy is ready to have that expense added to the judgement with which he will surely be hit.

  7. Probably easier to notify the social security admin about upcoming judgement and allow them to payroll deduct. Two things will happen, John will actually receive payment due and Billy will immediately let everyone know where he is.

    • as a representative of the small ground dwelling rodent defense league, I need to remind my fellow colleagues that depictions of common ordinary rodents for politics purposes or outright mockery is forbidden unless there is a damn good reason

      • I would not call a groundhog small in terms of terrestrial rodents. It is far larger than a chipmunk or a mouse. And while smaller than a capybara, they can weigh over 30 pounds. Maybe ‘Medium sized’ would be more apt.

        • This past summer we had one visit our patio periodically [getting seed the birds kicked out of a big feeder] that my wife nicknamed “FatBoi” due to his size. Maybe I’ll see if I can find his burrow and see if there’s someone hiding out it it.

  10. I see recently a niece (?) of Billy’s was arrested for felony forgery right there by the homestead in Iowa. Guess that trait runs deep on the Schmalfeldt genes.

    Hey Roy, be honest, his branch of the family were always the thieves and beggars of the clan weren’t they?

    • Well, when you have no smarts, no common sense, loose morals, poor skills, and bad values, what do you expect?

      Like I said elsewhere, the record is about 50/50.

      Pretty sure it’s a combo of nature and nurture.

  11. I think it was nice of BS to confirm that he has life insurance, so that the proceeds can be attached, to revert to WJJH upon BS’s demise.
