This was filed in the Kimberlin v. Frey RICO Remnant LOLsuit on Friday—
If the Fourth Circuit Court of Appeals rules on The Dread Pro-Se Kimberlin’s petition for a writ of mandamus within 90 days of its being filed, we should hear something later this month, perhaps as early as next week. Meanwhile, I still have a dog in this fight. TDPK’s motion seeking sanctions against me because he didn’t like my response to an improperly served subpoena is still pending. (Rather than ignore an improperly served subpoena, I voluntarily gave Kimberlin what he asked for because it was useless to him and because I wanted to avoid a bunch of nonsense motions. I was rewarded with a motion for sanctions.) Judge Hazel has said that he won’t deal with sanctions until after the case is decided, so that motion is in limbo until the case winds down.
