Late this morning, Judge Hazel ruled on three outstanding motions in the Kimberlin v. Frey RICO Remanant LOLsuit.

There are a couple things worth noting in the judge’s rulings on my motions. First, my motion for a modification or exception to the Protective order was denied as unnecessary. The judge instructed me simply to tell the other court how Kimberlin had violated the Order. Second, he granted my motion to seal the emails that Kimberlin filed in Hoge v. Kimberlin, et al.—something that he should not have done unless they were, in fact, confidential discovery from the Frey case.

Judge Hazel also denied Kimberlin’s request for leave to file an interlocutory appeal.

Everything is proceeding as I have foreseen.

  4. I wonder if the judge knows that the “members of the media” and “the press” referenced as making inquiries about this case are in fact Kimberlin’s self-described (in sworn court filings, no less) “associates”?

  6. When will Kimberlin finally meet a judge who holds him accountable for his actions? Kimberlin has a long history of violating court orders to seal documents and hasn’t had to pay for those contempt of court violations.


  7. I can’t believe Judge Hazel wasn’t at all moved by the great journalist of our times Bill Schmalfeldt wanting to write a counter-story. Doesn’t he know who Bill Schmalfeldt is?

    But on a serious note, Brett if you’re reading this, put some BenGay ointment on your sore and caved in nuts. I’m not kidding it’s a fail proof home remedy and you’ll feel much better.


    • Assumes facts not in evidence, re: nuts. After all, this is the same guy who won’t put his return address on an envelope sent to our host. He’s afraid he’ll get served.

    In this case, the pedo-diddler has it caught in the wringer.

    He can’t deny that he abused sealed discovery, after being told “no”, quite clearly.

    It’s all caught on paper…


    • So what? It only matters if he pays a significant price for doing so, which hasn’t happened so far. What are the odds that the court will take serious action against him this time, instead of just getting rid of the latest failsuit and hoping the next one lands on someone else’s docket?

      This was never about winning in court, although that would be icing on the cake for TK. The goal has always been to get detractors to SHUT UP!! Doesn’t seem to be working very well though. (snicker)


  9. I say at least 15 tonight. He has become “John the Baptist” of the progressive left urging progressives to leave no arrows in the quiver and join the good fight against Hoge. He thought Karoli was his Jesus but she told him to leave her alone like most women in his life.

    I would assume he would be willing to baptize any converts in a tub of mayonnaise if they so desire.
