Legal LULZ Du Jour

28 U.S.C. § 1400(a) states:

Civil actions, suits, or proceedings arising under any Act of Congress relating to copyrights or exclusive rights in mask works or designs may be instituted in the district in which the defendant or his agent resides or may be found.

IIRC, Sarah Palmer lives in the Middle District of North Carolina. I’m reasonably sure she can’t be found in Milwaukee. The Cabin Boy™ will have to file in Greensboro to sue her.

  1. “Most of this stuff is written simply enough that lickspittles can grasp it.”

    — William Smellfart, Twitter Attorney at Law, collector of multiple court orders from multiple states for harassment and stalking.

  2. Ha! He’s backing out already.. totally predictable..

  3. I don’t know if he will do it, but I believe a lawyer will take what’s left of that insurance payment under 17 USC 505. When the judge finally sees how dumb this suit is, and sees how many other dumb suits he has filed, that judge will be very receptive to imposing sanctions.

Btw, having a suit dismissed for improper venue is “prevailing” under Sec. 505.

To be fair, we will lose a great deal of money before this case is over… on popcorn.

  4. I was hoping to wait until he actually filed in Wisconsin before telling him. If Twitter Attorney at Law William is serious about filing federal lawsuits, he is going to HAVE TO hire an attorney. I’d love to sit in on the initial consultation. That would be one of the biggest lulz to date.

  5. Does Billy have the bucks to serve LULZ VI?

Does he have the bucks to mail the copyright suit to the proper court?

Does he have the bucks to file …..

No to all because Gail’s life insurance money is already gone.

  6. Hmm.

    See: pro hac vice.

    • Wait, isn’t this the guy that just yesterday said he spent the afternoon with an attorney and then quoted exactly what the attorney told him only to have it found out that he is once again lying to lawyers on internet legal advice sites so he can hear what he wants? Didn’t it also come to light that the quotes from “his lawyer” were pure fiction?

For someone that gets hilariously and publicly humiliated time after time, he really doesn’t know when to quit.

  7. The anticipation! If an actual lawyer comes onboard for the defendants in LULZsuit VI: The Undiscovered Krendler, Bill Schmalfeldt’s head will explode. And if Bill really is stupid enough to file a copyright suit, well, I just may have to jump into THAT scene, so I can get my fair share of figuratively kicking Bill’s ass.

  8. Interesting post at KU:
“We wish to clearly state that at no time has Sarah Palmer sent us any images or other material to host. Indeed, as near as we can tell, she has never sent us anything.

OK, so how did all those Billy Sez images get on the kimberlinunmask server?

We put them there when it became obvious that Mr. Bill was going to go through with another round of false DMCA notices. We believe that David Edgren was within his rights when he put the Billy Sez images into the public domain. We put a set of images that should be freely available to anyone beyond Mr. Bill’s ability to mess with them.

That still leaves the question of how we got them.

We downloaded them from Billy Sez as they were posted last year and placed them on an off-line storage drive. The most recent download date was July 19, 2015, almost six months ago.”
