It’s that time of year again when the Top Ten Lists for the year in review get published, so here’s the next two entries on the TKPOTD’s list of the Top Ten Team Kimberlin Stories for 2015—

8. The Cabin Boy™ Sues in State Court

When the Dreadful Pro-Se Schmalfeldt had his first federal LOLsuit of 2015 thrown out because he had filed it in the wrong court, he tried to correct his error by filing a similar LOLsuit in the Circuit Court for Howard County, Maryland.

On 3 June, there was a hearing before Judge Kramer on my motions to dismiss. One was for failure to state a claim upon which relief could be granted. The other was for improper venue, that is, I was claiming that we were still in the wrong court. Judge Kramer agreed with me.

UPDATE—I haven’t received a copy of the order yet, but it appears that the entire case has been dismissed. That would be in line with a finding of improper venue for me. Venue would have been proper in Howard County if the court had jurisdiction over the other defendants, so for venue to be improper the suit would have to have been dismissed for them as well.

7. The Cabin Boy™ Runs Away

Stupid is as stupid does. Schmalfeldt initially filed his second federal LOLsuit of 2015 against Patrick Grady, but he decided that he should add additional defendants. One of them was David Edgren, a retired lawyer from Wasilla, Alaska. If an aggressive pro se defendant like me could make things tough for the Cabin Boy™, a lawyer with time on his hands made things unbearable. David began by going after the Cabin Boy’s™ pauper status and kept piling on motions.

Another defendant he added was Scott Hinckley who, along with Patrick Grady, began pushing back in ways that made it clear that The Dreadful Pro-Se Schmalfeldt had bitten off more than he could chew.

The Cabin Boy™ threw in the towel, dismissed the case with prejudice, and slunk off to Wisconsin.

  1. Is there any readily available list of all the named and unnamed defendants on the Second Federal suit? On the unnamed victims I think he identifies some by commenters name on Hogewash & TMZ. I’m just wondering who gets dismissed after those he actually named.


    • Actually, I think dismissal isn’t Billy’s aim. His aim is to “out” as many Lickspittles and Zombies as possible…then harass the bejesus out of them.

    No matter how much of shithead Bill Schmalfeldt is, Brett Kimberlin is still the sociopathic, terroristic, felonious, bomber diddler.

    Brett Kimberlin bombed absolute strangers in the parking lot of a high school football game.

    What a great guy.

  3. According to his latest screed, he left Maryland because he didn’t want to keep taking the dogs out. A couple weeks ago, he said he left because he didn’t want to fight anymore. He abruptly filed to dismissal with prejudice on a week after claiming he was going to drop it, only to blame Hoge for making him continue his own.. lawsuit.

    TJ has yet to comment on it, but sources suggest that Bill had been “forced” to leave via ultimatum because TJ found out he might have to testify in trial to validate his pauperis status and their relationship was already rocky due to the way Bill handled his Mom’s death.

    I guess it depends on who you really believe but its interesting to listen to someone yell, “LYING LIARS!” at everyone else when Bill keeps changing his story.

    • Didn’t a certain investigative reporter start harassing a grieving family because he claimed someone was changing their story? Wouldn’t that mean according to “Investigative Journalism Rules by Bill Schmalfeldt” that citizen reporters are free to start contacting and threatening whoever they like to ‘get the story’ about why Bill really left? If there is one thing that the great reporter William “Stolen Valor” Schmalfeldt has taught us it’s that threatening folks and going after families are a perfectly acceptable trick in the reporters arsenal.

      • He believes that because he initiated the court action, he gets to dictate how it will go. All he needs to do is ask his in awhile.. um.. that one guy Brett Kimberlin how that works out for a pro-se, especially suing so many people. ..uh.. hmmm..

        Actually, it’s just funnier letting him believe whatever story he comes up with at the moment. Man, have I eaten a lot of popcorn this year..
