Team Kimberlin Post of the Day

The Gentle Reader who has been following The Saga Of The Dread Pirate Performer Pro-Se Kimberlin since at least the middle of last year may remember this comment he made in an interview with Dave Weigel:

And tomorrow, I can file another lawsuit against them. And now I know what I need to do. It’s going to be endless lawsuits for the rest of their lives. And that’s what it ends up being. I sue them. They sue me. They come into court. I sue them. They come into court. That’s the way it is.

Last week, TDPK filed a motion to have the dismissals in the Kimberlin v. Most of the Universe, et al. RICO Retread LOLsuit of Breitbart, Michelle Malkin, Twitchy, Glenn Beck, Mercury Radio Arts, and The Blaze converted into a final judgment. This would allow him to file a separate appeal for those defendants—which fits with the strategy he enunciated after having his butt kicked in 2014. Of course, it may not be the wisest thing for TDPK to do because [redacted].

movie popcornMeanwhile, the hearing on Aaron Walker’s motions to dismiss and for summary judgment is on the docket for 9:30 this morning. I plan to be there and report on what I see and hear.

  1. What is it going to take to declare the midget a vexatious litigant? I know Popehat was trying to get something done but I haven’t heard of any progress

    • Saw that. What did happen? Did judge just want to look at the law, or did he express a view/reservations?

      • That means that the judge listened to the evidence presented, if any, and oral argument and maybe said that the motions were taken “under advisement.”
        That means no instant decision.
        The judge may have said when a written decision will be issued.
        Most likely the judge did not give a date and the written decision will be issued when the judge’s research has been completed and judge’s writing of the decision has been completed.
