The Court of Appeals for the Fourth Circuit has dismissed The Dread Pro-Se Kimberlin’s appeal of the U. S. District Court’s dismissal of all but one of the claims in his Kimberlin v. The Universe, et al. RICO Madness.

I’ll have more to say about this later.

    • The Circuit has decided based on venue … that it has no jurisdiction, thus it cannot rule on sanctions as it has no ability to do so, thus the sanctions motion is mooted.

        • Some people are unable to control themselves and have to make a full pot, fill a glass full to take a sip, fill a depends to bursting before changing it, etc, etc, ad nauseum, ad infinitum …

        Venue is not the reason.
        The Court denied the appeal because
        “The order Kimberlin seeks to appeal is neither a final order nor an appealable interlocutory or collateral order. ”
        The case in the District Court is not over because the §1983 claim against Patterico has not been decided.

    • They may not be, but as the court has decided it has no jurisdiction, it can do nothing, thus the sanctions motion is mooted … they cannot do anything without jurisdiction.

        On another note, I was scheduled to go on a Greek cruise with my spouse, but I bailed on the way to the airport because I decided I wanted a smaller coffee pot. Isn’t that what everyone does?

      • Yeah, you know, I was stopped by the police for speeding, but before he could write the ticket the policeman decided he wanted a smaller coffee pot and let me off with a warning. I heeded his warning and immediately purchased a smaller coffee pot for myself. Quite useful. Everyone should do it.
