January: Kimberlin Gets Caught Forging a Summons

Irony Alert!

One of the major defects of The Dread Pro-Se Kimberlin’s response to the motions to dismiss from Aaron Walker and me is his attempt to use it to allege new facts to support his fatally weak amended complaint in the Kimberlin v. The Universe, et al. RICO Madness. Here’s an example.ECF 29-28He also makes reference to alleged violations of 1512(b) and 1512(d) in his response, but, of course, neither (b) nor (d) nor (k) are mentioned in his amended complaint. If he wants the court to consider them, he will need to file a second amended complaint, and that will require the court’s permission.

<irony>18 U.S.C. § 1512 is a federal witness tampering statute. Here’s what 1512(c) says:

(c) Whoever corruptly—
(1) alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object’s integrity or availability for use in an official proceeding; or
(2) otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so,
shall be fined under this title or imprisoned not more than 20 years, or both.

… alters, destroy, mutilates, or conceals a record, document, or other object …forgedsummonsYes, perhaps the court needs to consider possible violations of § 1512.</irony>

Rauhauser’s End Game?

First Mate Neal Rauhauser ran a blog hosted by called Conspiracy Broker for a while (No, I won’t link to it.). He put what he called his last post for that blog up on 2 January. It contains this paragraph:Conspiracy Brokers 20140102So, he thinks he will benefit from The Dread Pro-Se Kimberlin’s vexatious litigation, does he?

We shall see.

Stay tuned.

I wonder how Rauhauser feels Kimberlin’s lawfare is working out for him?

Tomorrow, we’ll take a look at the stories from March and April.

  1. I wonder if Rauhauser and Kimberlin are even on good terms anymore. I doubt it.

What’s more important is that both owe great debts of atonement to their victims for their separate and joint wrongs they committed.

      • Lee is saying he knows exactly who it is. It’s definitely not Matt. But Matt and XCitizen10 have something in common: they both think it is ok to wind CBBS up to viciously harass people they disagree with.

After reviewing CBBS’ s (short) career as a producer and seller of child porn, I guess they will only have a few more months or so with which to use CBBS to harass people. CBBS has really screwed up this time. And in the service of an utterly contemptible cause.
