In Re Kimberlin v. Walker, et al.

We go to trial on Monday. Aaron Walker, Stacy McCain, Ali Akbar and I are confident that we will be vindicated. After I return from work today, the weekend will be spent preparing for the trial. Blogging is likely to be very light for the next few days.

I got involved in all this when I became aware of Brett Kimberlin’s anti-First-Amendment activities, especially his attempt to use a peace order to unconstitutionally gag Aaron and his calls to Stacy’s wife’s employer that resulted in the McCain family moving to an undisclosed location. I stuck with the story and was able to cover the various trials and hearing in nearby courts during 2012.  By late 2012, I had become a target of Team Kimberlin as well. By 2013, I became enmeshed in the legal wrangling myself.

I’m looking forward to the trial, not because I enjoy being sued, but because it will bring closure to one part of that wrangling.

I’d like to thank all you folks who have been supportive of my codefendants and me this past year. The best way that you can support us now is with your prayers. The second best is by supporting the Bomber Sues Bloggers fund. Our lawyer is pro bono, but there are other expenses incurred in our defense. The certified transcript for the 1 July hearing cost about $120. Another thing that you can all do is refrain from speculating on either side’s trial strategy. Brett Kimberlin is really quite a doofus in a courtroom. Please don’t give him any hints.

For now, I won’t be writing about this case. There’s plenty of other Team Kimberlin stuff to publish. There’ll be plenty to write about concerning Kimberlin v. Walker, et al. after the verdict.

Please remember that the Lady Schmalfeldt considers herself as brilliantly ‘helping’ TDPK by ‘selflessly’ fighting a self-styled guerrilla war on his behalf, but in reality she is nothing more than a ‘worn-out’ camp follower. I predict an exceptional display in the next few days from Lady Schmalfeldt of bizarre meltdowns, attempts at diversion and unrelenting harassment plus extortion in an attempt to shake your resolve. When trial day arrives, remember that TDPK will be there with no attorney, no support and no case. You will be supremely rewarded.


    • And we all understand that “Lady Schmalfeldt” is a term which means Bill Schmalfeldt. Mr. Hoge has made it very clear that family members are not to be brought into this. (Tao was NOT referring to a family member.)

      No offense Tao, but he’s used that term once out of context to pretend that we’re bringing his wife into these things.


      • To all, including Lady Schmalfeldt – who is in fact William M. Schmalfeldt of Elkridge, Md – my term “Lady Schmalfeldt” applies to him because of my utter disregard, distain and disrespect for him. I have only seen such evil cruelty in the reviews of the Soviet Stalags, Chinese prison camps, North Korean society, and other despotic regimes. The Lady Schmalfeldt, in my considered opinion based on his acts and writings, is a seriously ill psychopath capable of the vilest of evil acts and deeds. He lives solely to hurt, driven by a rage so deep within him at all humanity’s absolute failure to venerate him in the manner (manor) to which he feels he was destined. He is not alone. Why even on a daily basis, the noted author of “Mein Kampf” walks alongside her in her sick, twisted mind while she carries the ever-present jar of Hellman’s.


      • Funny thing is, he complained in a sworn motion to the judge about his wife being attacked by being called Lady Schmalfeldt and just a page later includes another comment from Tao that specifically says Bill is Lady Schmalfeldt. Not sure how provably lying in a sworn motion to a judge is going to help out old Stupid Bill. He really doesn’t think things through fully.

  3. Mr. Hoge, our prayers are with you. Let’s hope the jury understands how important this is. Kimberlin wins and all citizen journalism stops. We simply will not be able to discuss public figures at all.


  4. Prayers for all the defendants that justice will prevail and this will all come to an end soon.

  7. Best wishes to Mr. Hoge and his co-defendants. Given what I’ve seen of BK’s filings they should prevail. This will not be the first, nor I suspect the last, instance where these clowns lose in court or have been proven wrong in their premature jubilation about the outcome of a specific case due to serious lack of understanding of underlying case law.


  8. The good thing is that at last this travesty will be over with, and BK’s ability to torment the defendants over with too…at least for now.


    • Only for this case, without a vexatious determination, they will continue as before as they have faced no negative repercussions from their actions.


  9. Even if BK is deemed a vexatious litigant, what’s to stop Rauhauser, et al. from picking up the banner?


    • Rauhauser would be arrested if he showed up in court. He has four warrants out on him. Funding may also be a problem.

      Rauhauser simply works for Brett. They only share the same enemies because Brett paid Rauhauser to attack Brett’s enemies. Additionally Rauhauser gums up his clients due to his own side-agendas and he has an accidental tendency to unite the victims of his different clients.
