Yesterday, the Supreme Court ruled that recess appointments made by the President when Congress is not actually in recess are unconstitutional. That seems obvious enough, so one wonders where the President was getting his legal advice.

There have been numerous times when the Obama administration has pursued legal theories that were basically frivolous, and gotten beat as a result by astoundingly unanimous Supreme Court decisions.
Often at what were tactically and strategically bad battlegrounds, like the NLRB – as hundreds if not thousands of cases are now void.
It is a good question where he has gotten that advice, because of the sheer ineptitude of it.
