Team Kimberlin Post of the Day

In his struggle to invent a racketeering enterprise to sue in his Kimberlin v. The Universe, et al. RICO Madness, The Dread Pro-Se Kimberlin has tried to claim that the Defendants engaged in acts of extortion. This is from his proposed second amended complaint.EFC 100-190That’s the sort of nonsense we Defendants are talking about when we point out that his proposed second amended complaint is futile because it doesn’t address the points raised in our motions to dismiss his first amended complaint. For example, my motion to dismiss notes that TDPK has failed to allege any of elements of extortion.ECF 5-8Threatening to sue or actually suing someone isn’t extortion. OTOH, telling someone that if he doesn’t give you something or do some act for you, he will be accused of a crime is extortion.

Why does that second scenario sound so familiar.

  1. No, it’s only extortion if you’re NOT an investigative reporter working on a story. All great reporters threaten potential sources with with criminal charges, lost custody of children, etc, to get the scoop.
