#Brett Kimberlin Files Yet Another One

The Dread Pro-Se Kimberlin also filed a reply to Ace’s opposition to TDPK’s motion for a subpoena. That generated a further response from Ace’s lawyer, Paul Alan Levy.

UPDATE—That bit from TDPK in paragraph 6 about it being unfair to the other defendants that Ace hasn’t been served is pure concern troll nonsense. As far as this defendant is concerned, I wish every one of us had been as fortunate as Ace has been thus far.

  1. Is it just me who feels like he keeps telling the judge and the defendants to bend over and yell, “thank you, sir, may I have another?”


  2. Wasn’t there also something about length of reply in the judge’s orders, to the effect of no more than 25 pages?


      • It didn’t seem that much of the non-exhibit stuff was really germane either, especially since, as is pointed out, even if Levy were to be disqualified, it wouldn’t change anything since there are other lawyers involved also.

    Are you suggesting that he may not be all that concerned about the eleventy million people he’s, um, suing? O_o


  5. The core of his complaint is that the defendants (and Levy) are “profiting” from their malfeasance by accepting donations. But that’s ridiculous. The defendants are asking for donations. No one is compelled to donate, or threatened to donate, or required to donate. They can individually choose whether to give money to the bloggers.

    Asking for donations does not create actionable conduct.

      Well, there are commonalities between TDPK and Planned Parenthood. Both have a body count, for instance.


  6. Every time I re-read this, I find more weird stuff. For example, BK is arguing A-C privilege on behalf of BU. BK is not a lawyer, BU is not a party, and BK does not have standing to argue A-C privilege on behalf of BU.
