Roger and Me

Well, we’ll, well … I now have something in common with Roger Schuler. For those of you don’t know, Schuler is the wacko moonbat who used to publish Legal Schnauzer. I say, “used to,” because he’s now in the slammer for contempt of court.

Shuler was sued for defamation, and the plaintiff sought a preliminary injunction requiring that the allegedly offending material be removed from the Internet. Shuler managed to lose that motion by default. Shuler wound up in jail because he mishandled his response to what should have been an patently unconstitutional court order.

You see, that sort of preliminary injunction flies in the face of the First Amendment. Even a permanent injunction issued after a hearing on the facts is highly irregular. The law is very clear that monetary damages rather than injunctive relief are the proper remedy for defamation.

That being the case, the Gentle Reader should not be surprised that The Dread Pro-Se Kimberlin has filed a motion for a preliminary injunction in the Kimberlin v. Walker, et al. nuisance lawsuit to require that my codefendants and I must take down any blog posts about TDPK we’ve made since 7 July, 2013. After all, given his history of robust anti-First-Amendment activism (aka brass knuckles reputation management), why not double down?

Roger Shuler is in jail because he stupidly defied a judge rather than presenting a reasoned defense. I plan to go with a reasoned defense. My lawyer will file a timely opposition to the motion.

  1. BS also wants you to “control” what your commenters say. Odd, isn’t it, that someone who considers himself an expert on libel keeps calling all of you the defamatory five, when you have not been found guilty of defamation. Maybe he should control himself.

And before anyone (CBBS) decries that TDPK is a private citizen and therefore cannot violate the 1st Ammdt.; once he motions the court, he is involving the government and therefore the 1st comes into full play. ESPECIALLY given TDPK’s notorious status as a public person, and the very political nature of the commentary.

    1st and 2nd go together like a warm snuggly blanket and a cup of cocoa.


    • Works for me, but I prefer a 20 ga with #8 shot for around the house. It packs twice the energy of .44 Mag load, but it won’t penetrate 3 layers of drywall. A Model 1911 and an M1 Carbine are the other usual options.


    • I’m old school. My paternal grandfather left us a Colt Police Positive Special and a Winchester Model 1887. Antiques of course, but they work.
