I normally would save something like the following for a Team Kimberlin Post of the Day, but I’ve been laughing so hard and shaking my head for so long over this one that I’m going to share it now.
I’ve been slogging my way through The Dread Pro-Se Kimberlin’s responses to four of the motions to dismiss the Kimberlin v. The Universe, et al. RICO Madness. In paragraph 23 of his Response to Defendant DB Capitol Strategies Motion to Dismiss TDPK tries to allege that DB Capitol Strategies was engaging in fraud because it operated a legal fund in support of Aaron Walker’s suits against Brett Kimberlin in 2012. He cites as evidence his Exhibit J, a blog post from Crooks and Liars. The best “evidence” he can come up with an unsourced blog post by Matt Osborne, Alex Brant-Zawadzki, Bill Schmalfeldt, and Melissa Brewer?
#ROTFL
OMG, he seriously is saying ” I know they were committing fraud cause my friends say so!!”… in a court document no less…
ROTFLMFAO!!!!
I once got full credit on a college exam for citing “Martin’s Law”. That “law”, made up by a friend of the family, amounts to “because I said so”.
I once verbally cited Cole Slaw as an authority. And got away with it.
Cole’s Slaw is valid for sufficiently thinly slice values of cabbage.
So Brett is putting the (dubious) credibility of Osborne and Brant-Zawadzki on the line with his lawsuit? Never heard of Alex Brant-Zawadzki before this but I don’t follow these guys much.
I’m troubled by your phrasing: Matt Osborne has no credibility to be put on the line.
All my material is extensively sourced. To say otherwise is blatant libel.
All my meticulously referenced stories on Akbar and his coevals – going back to 2009 – can be found at http://www.huffingtonpost.com/alex-brantzawadzki
Is this the same Melissa Brewer who is the crazy cat lady and woman arrested for prostitution in Maryland?
Did they list those on her CV in the court filing? It think it would go a long way to proving a certain level of “street cred.”
Or am I getting the cast confused? We need a full cast of characters in this twisted story.
Yes, I believe that’s the woman that the gals from Unite Blue (Democrats) researched. Their own side doesn’t even get along with any of those people. Who could blame them?
Does submitting that blog post as evidence mean those four people can be subpoenaed during discovery?
Or trial.
Bwa ha ha! And US district courts do not take kindly to no-shows who ignore subpoenas.
I was thinking the same. Please put them on the stand as “experts” on fraud.
I second that thought, Katie! Oh, please do subpoena them in a trial, Mr. Hoge!
Having the clown posse subpoenaed is the least of Kimberlin’s worries. I don’t think the court would take kindly to being informed that the relationship between Kimberlin and Schmalfeldt is one of business partners in one venture, by indisputable fact, and, employer-employee in others, by considerable circumstantial evidence. The circumstantial evidence certainly rises to the point where Kimberlin would have to go on record as affirming or denying it. If he affirms that Bill Schmalfeldt was his employee, citing the writings of subordinate employee without disclosing that fact was a fraud upon the court. If he denies it, the JTMP and Velvet Revolution could be subpoenaed to produce all their financial records. As corporations, they have no right to take the fifth.
Its pretty clearly not admissable “evidence” of any sort.
It’s evidence that Kimberlin’s fan club is made up of loser and clowns, but this fact has no bearing on the outcome of anything.
A legal concept that seems to escape Team K is that of “standing.”
It is nice to see that Mr. Kimberlin is finally coming clean by naming all of his associates in one neat exhibit. All of those names go back years with their nonsense. I hope it finally catches up to all of them in court.
oh the tears…”Bill Scmalfeldt is also an accomplished journalist.” and that’s just scratching the surface.
I like the bit about how the article (no link to the article I see) has 60 links sourcing the points in the article. Are they all of this same stellar caliber? Bets on how much circularity is going on in it’s references? Bet the map of the links looks the Schwarzchild radius of a black hole with all the light bending back in swallowing itself. That right there is Schmalfedlt’s oldest trick “I say so becasue I say o”. Need new material and tricks Bater.
Then one day they angered a Gypsy who put a terrible curse on them which made it impossible for them to commit any logical fallacy for one day, and they exploded on the spot, or were killed at the next zebra crossing, depends on who tells the story.
Zebra Crossings for $1000, Alex.
The way I heard it, they were either killed by an animated scarecrow or they slipped on a blood-colored fish and fell down a muddy hillside to their deaths.
I’m not sure if I prefer the straw man ending, or the red herring/ slippery slope combo.
Ah, good memory. “Yes, your honor, one of my cited authorities put a gypsy curse on the defendants, and was adjudicated a harasser.”
Ah yes, the oft promised, ne’er delivered Gypsy curse. I sent in box tops and everything. sad face.
Reblogged this on Dead Citizen's Rights Society.
Citing a post from a blog named “Crooks and Liars” as evidence? #SeemsLegit
Oh my ! LMAO!!!!!!!!! Bill Schmalfeldt a credible source?
