Team Kimberlin Post of the Day

RICOMadnessThe Dread Pirate Pro-Se Kimberlin has filed a frivolous and vexatious RICO lawsuit against 20+ defendants, including me. I was given 60 days from 19 October to respond to his Amended Complaint. I have done so with a Motion to Dismiss. Under Local Rule 105, TDPK now has 14 days to file any opposition to my motion.

Here is a copy of my motion. I do not wish to make any further public comment on it until the judge has ruled on it.

  1. Have any of the more prominent defendants filed responses? I’m thinking Simon & Schuster, Glenn Beck, Breitbart, etc…

        A motion for sanctions must be made separately from any other motion and must describe the specific conduct that allegedly violates Rule 11(b). The motion must be served under Rule 5, but it must not be filed or be presented to the court if the challenged paper, claim, defense, contention, or denial is withdrawn or appropriately corrected within 21 days after service or within another time the court sets. If warranted, the court may award to the prevailing party the reasonable expenses, including attorney’s fees, incurred for the motion.

  2. This legal brief seems brilliant to me. It brings out very important facts, that Kimberlin is a convicted perjurer, felon, drug smuggler and such. Kimberlin’s complete lack of any particularity, i.e., specific facts supporting his claims, appears fatal to his case. I very much hope that the Court dismisses his suit and imposes sanctions for filing a frivolous lawsuit.
