What I Saw in Court Today

Aaron Walker and I attended a session of District Court in Silver Spring, Maryland this morning. The reason for our interest was that Brett Kimberlin was a party to three peace/protective order cases.

As his cases were called, Kimberlin pointed to where we were sitting in the back of the courtroom and told the judge that we had been stalking him for “the past two years” and that we were only present to spread the “salacious details” of the cases on the Internet. He asked the judge that we be ejected from the courtroom or that the cases be heard in chambers. The judge told him, “No.” She said that the courtroom was open and the members of the public could attend.

For the record, I have only been writing about Brett Kimberlin since May, 2012.

Also for the record, there were plenty of salacious details concerning Mr. and Mrs. Kimberlin brought out during the hearing, and you will not find out about them via this blog. I don’t intend to discuss any more of the details of their family problems than is necessary to fairly outline the story. Brett Kimberlin was quite explicit in presenting salacious details to the court. I was surprised that he did this with his 9- and 14-year-old daughters in the room.

It appears from one of the documents filed with the court that Mr. and Mrs. Kimberlin have been separated for several months. Until recently, she continued to have some sort of position with one of the Kimberlin “charities,” and, as part of her compensation, she had the use of a company vehicle, a 2013 Toyota Highlander. When Brett Kimberlin found that his wife was in a relationship with another man (Jay Elliott), he fired her from her position with the “charity” and demanded the return of the company car.

The details become salacious at this point, but the net is that various criminal and civil complaints were filed. Rather than sort them all out, I’ll just tell you where things stand as of now.

Brett Kimberlin is now subject to a temporary peace order filed by Jay Elliott. Mrs. Kimberlin’s petition for a protective order was denied. Charges for harassment and related offenses have been filed against Brett Kimberlin by Jay Elliott.

Jay Elliott is facing criminal charges filed by Brett Kimberlin relating to removal of property and harassment. Brett Kimberlin’s petition for a peace order against Jay Elliott was denied.

Mrs. Kimberlin was arrested by Sheriff’s Deputies at the end of the hearing. I have not yet been able to find out what the charge(s) is(are).

My colleague Aaron Walker is reviewing the legal aspects of the case. I recommend that you check his blog for more information.

There will be more here at Hogewash! when I have more to report than rumors.

  1. Two things in the final paragraph.

    1) The link goes to allergic2bull.BLOGPOT.com instead of blogSpot

    2) that rumors should be than rumors

All of this was done with his kids in the courtroom? Man. I feel sorry for those kids, and hope that they are alright when all is said and done.

I can’t help but feel a little for Mrs Kimberlin too. I hope she is being cautious as is this Jay Elliot person.

  3. This line in the above story stood out to me, “… there were plenty of salacious details concerning Mr. and Mrs. Kimberlin brought out during the hearing, and you will not find out about them via this blog. I don’t intend to discuss any more of the details of their family problems than is necessary to fairly outline the story.

Thus the difference between Mr. Hoge and Team K. If the roles were reversed, TDPK would be jumping for joy as he typed out all the details. Mr. Hoge has more integrity in his little finger than all of Team K combined.

      agreed.

  5. Aww, poor Billy is now complaining about people sticking their noses where they don’t belong re the Kimberlin’s issues. Hmmm…guess he already forgot about his meltdown just the other day where he went after Mrs. Stranahan about her dead child. And how he went after Lee before that. None of that was any of his business but he seemed to take great pleasure in sticking his nose in that. He really is the most self unaware person I think I’ve ever run across.

CWB–Funny, Neal and Brett had no problem recording me from afar before the proceedings on May 15, 2012, outside the courtroom, and Brett, from the middle of the courtroom from his iPad.
I know that they were waiting for me to make a big deal out of it. It wasn’t until I was walking past Brett that I noticed he was holding it up in front of his face as I passed. I then told the cop at the metal detector, and he let me tell the judge. As I went back in, Brett “slipped out” the side door so he couldn’t be admonished. The judge had Neal stay until I left the premises.
In a blog post late last year, Neal claimed that Doug Stewart and I ran around the courtroom telling anyone that would listen that “Neal had arrest warrants?, which is untrue, because Brett has tape of it, as do I , along with transcripts.
According to your account, Mr. Hoge, they try to censor even the words that you are able to hear. Typical of online terrorists.
