It was a mixed bag yesterday, but there was one thing to come out of the Hoge v. Schmalfeldt hearing that will cause Stacy McCain to smile.

Part of Schmalfeldt’s lawyer’s defense of his client had the effect of proving that Bill Schmalfeldt is not, in fact, a journalist.

Ridentem alta voce.

  1. I suspect you’ll find the courts will consider him a “journalist” when necessary to protect him, and “not a journalist” when that’s necessary.

  2. I suspect that that the courts just don’t want to get involved as to what they perceive as an internet fight. I would assume that same would be true if Mr. Schmalfeldt brings any action against Mr. Hoge, it gets thrown out because they don’t want to deal with it. Not because someone is protected or has special privileges, but simply because the courts could not be bothered with it.

  3. Like Deb Frisch, nothing will be done until an apparatchik is threatened.

    I grieve for what our system of justice once was, and die a little inside each time I realize what it has become.

    That said, it’s a grand and merry fight to save the nation for the kids, the grandkids, and those who follow!
