Statement In Re Kimberlin, Rauhauser, and Schmalfeldt

As folks are becoming aware of charges that I have filed, I wish to make the following statement.

Yesterday evening, evidence was presented to a District Court Commissioner in Westminster, Maryland, and the Commissioner found it sufficiently persuasive that he issued summonses to Brett Kimberlin, Neal Rauhauser, and Bill Schmalfeldt for Harassment and Misuse of Electronic Communication. A summons was also issued to Bill Schmalfeldt for Unauthorized Access to a Computer.

On 19 April, preliminary hearings will be held in Westminster to determine if there is probable cause to try these individuals for the crimes indicated.

I will have no further statements concerning these matters until I am advised to do so by the State’s Attorney or my lawyer, except to say that 1.) continuation of past behavior could result in additional charges and that 2.) other investigations continue.

  1. This is a big development, however, in reading between the lines, I can’t help but wonder if there is a risk of ‘unauthorized access to a computer” to people who read and make comments on your blog?

    • That’s a fair question. All I say for now is that posting threats or posting or attempting to post under someone else’s ID are violations of this blog’s and/or’s Terms of Service.

      • Oh dear, I was misunderstood!This wasn’t a threat, just a worry about my own computer. I was worried that your site had been infected with a malicious virus. There is so much in the news today, even Apple was hacked. I like checking your site and enjoy your posts, especially your quotes of the day. I have printed some of them for inspiration. Keep up the good work!

        • I never interpreted your question as anything other than asking what sort of activity in the Comment Section might cause a problem.
          As to viruses … does a good job of keeping their servers clean, and I scan for various kinds of trouble several times a day.

  4. I’m tired of watching Seth Allen attack you @wjjhoge, @Patterico, @Stranahan and @Rsmccain.
    Seth Allen claims nothing was done to rectify what was done to him by Rauhauser. IT’S OLD NEWS! His “schtick” is old and boring, all he does is attack the good guys noted above. It’s not about you Seth you need to stop shooting off your mouth.
    Oh and Seth, before you harass Stranahan about his dental issues (which is due to diabetes) maybe you should take your dentures out and look in the mirror. Whats your excuse?

    You are embarking on a noble endeavor. Yes you will be facing “human” men in court, but as Paul wrote to the Ephesians, “For our struggle is not against [a]flesh and blood, but against the rulers, against the powers, against the world forces of this darkness, against the spiritual forces of wickedness in the heavenly places”.
    To all of the Hogewash followers, please pray for Mr. Hoge and all who are involved helping him in this endeavor. It is my prayer that God would surround you all with his hedge of protection and that the evil that comes at you through these “men” would return to them a thousand fold.

  7. Unauthorized access of a computer has yet to be thoroughly defined. You might recall the case of Lori Drew and the suicide of Megan Meier in which Drew was charged for creating a fake profile on MySpace. Drw was convicted by the jury, but the court set the verdict aside.
