#BrettKimberlin Chickens Out


When Judge McGann denied Brett Kimberlin’s petition to quash John Norton’s appeal as moot, Mr. Kimberlin dropped his request for a Peace Order. That allows him to avoid testifying under oath concerning some of the claims he made in District Court.

More later, but for now Aaron Walker and I are headed to get some popcorn for a morning snack.

UPDATE 2–I had driven down from Westminster, Maryland, to pick up Aaron Walker at his home in Virginia. Before making the trek back to his place, we stopped for lunch at a local restaurant chain. It seemed fitting given the events of the day.

Brett Kimberlin seems to be beginning to grasp the idea that his testimony in court is being closely watched and that he had better start sticking to the truth. If I were Mr. Kimberlin, I would not want to be cross examined on the testimony he gave in the District Court in the Norton case. He was smart to avoid being put on the stand today.

UPDATE 4—I just received an email from John Norton, the person who was the victim of Brett Kimberlin’s lawfare in this case. I enjoyed meeting him today. He’s struck me as a upstanding citizen, a rather mild-mannered guy. Clearly, he’s the sort of person that Brett Kimberlin would find “dangerous.” He has a background in EOD.

In his email Mr. Norton reminded me of this comment he posted the day after the event over at The Other McCain. Here’s the picture that he posted.

#BrettKimberkin Doesn’t Want to Go to Court Against John Norton


Aaron Walker has gone to the Montgomery County Circuit Court and obtained copies of Brett Kimberlin’s Motion to Dismiss and John Norton’s Reply in the Kimberlin v. Norton Peace Order appeal. He has details here.

Perhaps Mr. Kimberlin remembers how unsuccessful he was in Circuit Court in July. Perhaps he has realized that his sworn testimony in these cases is admissible as evidence of perjury, and he’s worried about keeping his lies straight.

Whatever. This is where things get interesting. Pass the popcorn.

Let’s see … There’s a hearing in Walker v. Kimberlin in Virginia on 31 August, and Kimberlin v. Norton gets retried de novo in Montgomery County Circuit Court on 5 September. The next couple of weeks will be busy.

Have you figured out which one of your stories you’ll be sticking with in the Norton trial? In the District Court you said that Mr. Norton was lurking in the bushes on the left side of you house. If the Google Street View picture is accurate there are no bushes on either side of your house other than a small shrub next to your neighbor’s driveway, but it’s nothing one could lurk behind.

You’re running out of stories as you’re running out of time.
