Moving right along with our fisking of TDPK, here’s a look at paragraph 4 of his Motion to Order Plaintiff to Cease and Desist and for Sanctions Against Plaintiff’s Counsel in the Virginia Walker v. Kimberlin, et al. civil suit.

… that Defendant Kimberlin is connected to a website called Bretibart [sic] Unmasked that has been critical of Plaintiff and his counsel’s conduct.
There is, of course, good reason to suspect that connection. Several posts were made to that website that contained information that should only have been known to Aaron Walker, his lawyers, or Brett Kimberlin at the time of the posting. It is reasonable to assume that neither Mr. Walker nor his lawyers were posting to that website. Who else is left except TDPK or one of his confidants?
What counsel fails to tell the court is that Plaintiff sued Plaintiff [sic] and Breitbart Unmasked in Federal Court in Maryland to muzzle them for exercising their rights to access the courts and freedom of expression after Defendant said that he would seek sanctions in the instant case.
Hello, testing, … I don’t think that Aaron Walker has sued himself. Perhaps TDPK is so rattled that he can’t proofread his own copy. In any event, the federal suit does not seek anything other than monetary damages for defamation against Breitbart Unmasked. It doesn’t ask that it or its operator be punished in any other way. The suit does ask that Brett Kimberlin be designated as a “vexatious” person. This would not prevent him from seeking redress in the courts, but it would require prior judicial approval of the reasonableness of any lawsuit he might file. On second thought, that could be an effective ban in his case.</mockery>
As we’ve seen, there seems to be very little factual, legal, or rational basis to TDPK’s filings in this case. But the silliest is yet to come.
I’ll be back with more fisking of this motion in further posts. And TDPK has filed at least one more motion past this one. And over the next few days, we’ll see if he obeyed the judge’s order about complying with discovery.
